DiviTrain is a trade name of Ressiva, a private limited company established under the laws of the Netherlands, with its registered office at Hunnenveld 11, 6846CM, Arnhem, the Netherlands. DiviTrain operates globally through the website www.divitrain.com (the "Site").

By accessing or using the Site, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not access or use the Site.

1. Eligibility

You must be at least 18 years old to use this Site. By using the Site, you confirm that you are legally capable of entering into a binding agreement.

2. Use of the Site

2.1. License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its content for personal, non-commercial purposes.

2.2. Prohibited Uses: You agree not to:

4. Online Training Access and Restrictions

DiviTrain provides access to e-learning content powered by third-party providers (e.g., Skillsoft). Upon purchase, you will receive login credentials via email.

By activating your course, you waive your right to withdraw under EU consumer law (Directive 2011/83/EU), as the digital content is considered "used" upon access.

You agree not to share login credentials or resell training materials. Breach of these conditions may result in immediate suspension or termination.

5. Disclaimer of Warranties

The Site and all content are provided "as is" and "as available" without warranty of any kind, either express or implied. We do not warrant that:

The Site will be uninterrupted or error-free;
The content is accurate, complete, or up-to-date;
The Site is free from viruses or harmful components.

Some jurisdictions (e.g., California) may not allow exclusions of implied warranties; in such cases, these exclusions apply to the maximum extent permitted by law.

6. Limitation of Liability

To the fullest extent permitted by law, DiviTrain shall not be liable for any indirect, incidental, or consequential damages arising from the use of or inability to use the Site.

In no event shall our total liability exceed USD $50, regardless of the form or cause of action.

This limitation may not apply in jurisdictions that prohibit limitation of liability for consumers.

10.3. Exceptions: Claims involving intellectual property infringement, misuse of data, or urgent injunctive relief may be brought directly before a competent court.

10.4. U.S. Residents: If you are a U.S. or California resident, certain local consumer protections and small claims court access may apply. Any class actions are waived to the extent permitted by law.

11. Changes to Terms

We may update these Terms occasionally. Any changes will be effective upon posting to the Site. Continued use of the Site after changes constitutes acceptance.
